An SR22 form is the actual form filed with the state department of motor vehicles (DMV) for your SR22 insurance policy. The policy is actually named after this specific form (which has the same name in each state).

SR22 insurance policies are required for drunk driving offenders nationwide in order to reinstate your driving privileges after the DMV suspends your license when you’re first arrested and subsequently convicted for drunk driving.

Before your driving privileges are restored you must seek out an insurance agency (or talk to your current insurance agency if they offer an SR22 form and get them to file the form with the state department of motor vehicles.

SR22 Form Description

The SR22 form is in essence an agreement between the insurance company and the DMV stating that they are providing the required coverage for you. As an Arizona real estate lawyer who deals on a daily basis with the consequences of foreclosure, I often wish that people had come to me sooner, before it becomes too late – or at least very difficult – to help them with the potential foreclosure of their Arizona home. Although I cannot speak to the legal options and consequences in other states, I am sure that most foreclosure lawyers would agree that homeowners who need help with foreclosure-related issues should speak to a lawyer sooner rather than later.

Did you know that police departments are partially funded by their own ticket enforcement program. In case you haven’t paid close attention to the news, were are in the worst economic shape since the depression. Included in this recession are state and local governments that are looking for ways to cut back. One of the suggested ways is job cuts and demotions. Police are part of local government and being on this bandwagon are no exception to the rule. They have been faced with budget cuts and are looking to also lay off officers as a result of budget cuts.

It should come as no surprise that one way to counteract the layoffs is to generate more revenue for the departments. Departments looked at new ways to generate revenue but the tried and true method for departments has been citations. This is a billion dollar industry country wide and has nothing to do with public safety. Sure citations deter some behavior, but that can be accomplished through other means. Driver education and safety programs could solve some of the safety issues but that will not generate the money as quick cash from the public’s pockets. This comes from the publics wallet and is easily converted to instant asset generation.

Police officer’s have what is called “officer’s discretion”. Officer’s discretion means an officer has a right to enforce the spirit of the law or the letter of the law using his judgment. Traffic enforcement should be at the discretion of the officer to enforce the law but the officer’s discretion is being taken away from him. Other officers are being told by their respective agencies to write more tickets so a squad averages

can be achieved. You see, was once called a quota is now called squad averages. As a former Arizona State Trooper of 20 years, we were told keep up with our weekly averages or we would be written up for poor performance. We would be compared to the rest of the squad and our weekly performance evaluations were compared to the rest of the squad. The commander would set the weekly ticket quota for an acceptable number and the officer would be required to write that amount of tickets. On my particular squad, we were to stop 40 cars per week and write a minimum of 20 tickets. If you wrote under the 20 tickets, you would be red flagged on your weekly performance evaluation. There would be a note in red on the evaluation to pick up the pace because your performance is substandard. If you continued to get substandard evaluations, the next step would be probation. They would put you on a six month probationary period that could result in termination. If you didn’t start writing 20 tickets a week, you would be fired for substandard performance. Oh, yeah, the officers would be required to also, take required emergency calls in performance of his duties in addition to filling his quota.

Has is come to you yet? Did you see anywhere that “public safety” was the main concern for writing more tickets. Of course you did not see it. Nowhere was it mentioned to any officer that the reason we write tickets is for public safety. We were to be ticket writing robots and absolutely had no officer discretion when it came to ticket writing ratios. You see, I would personally write 5 tickets a week out of 40 stops and I was told numerous times this was unacceptable. We were given written warning books but sometimes that would be taken away from us leaving the individual officer only the option to write the public tickets. I believed giving Joe citizen a warning versus writing a ticket would increase public safety and improve community relationships. I like helping people and educating them also about traffic safety. To further take away police discretion, the patrol cars and the officers were wired up to record the traffic encounter.
We were told that was protect us and in some cases it did. But the main untold reason was to give big brother more ways to monitor our performance.
Your see, less officer discretion and strained police budgets result in more ticket revenue generation. It come in a guise of public safety but really does not save lives. This does not include the court’s involvement who are also dependent of ticket revenue generation. Why do you think there is traffic court? To streamline revenue generation. The point I’m trying to make is sometimes it isn’t the officer’s fault writing the public a traffic ticket. The public should be on guard and drive safely. They should not be dependent on the watch guards to keep us safe,
but reliant on them own selves to drive safely and avoid tickets. Furthermore, the police should be given back more discretion in applying the law and not dictated by budget restraints resulting in a higher ticket ratio.

Traffic law should be enforced with absolute officers discretion and no quotas should dictate officer’s performance. Who’s policing the police to make sure citizens are not subjected to this type of law enforcement. There are some internal affairs investigations, but usually the good officer’s get burned by this. Civilian review boards are good but the do not have the training and background to really evaluate an officer’s performance.

These problems stated above are not going to be resolved anytime soon so what should the public do to defend themselves. Educate yourself with traffic laws and criminal laws. This does not mean you have to get a law degree or the like. It means know your rights as a citizen! Read civil rights journals and law enforcement bulletins at your public library. Ask local law enforcement for help if you have any questions about your particular situation. Most good officers would love to share their knowledge with yo

specially cover traffic enforcement and how to beat traffic tickets. There are many of them out there but I have found a great one that covers many areas of speeding and other moving violations. You see, knowledge restores the balance of power back to the public. Don’t go unprotected in this day of bad economic times. You will fall prey to budget restrained police departments and courts dependent on your hard earned cash to get them out of the hole.

I recently talked with an old friend of mine who had a run in with the law. Because I used to sell insurance he like everyone else asked me how much it would raise his rates. He told me that he went to a holiday party and had a few drinks then drove home. On the way home he was pulled over for speeding and the police officer asked him if he had been drinking. His first thought was to say no but he didn’t know what he should do so he said he only had two drinks. Well he ended up getting a ticket for driving under the influence and now is trying to figure out what his mistake will cost him.

If this story sounds familiar it is a very common occurrence especially around the holidays. People go to parties to say hi and have a drink or two then drives home. It can happen to anyone including the chairman of Coors brewing who was issued a drunken driving ticket in 2006. Now the question becomes how much it will cost me. The bad news is that your insurance will increase but the good news is it doesn’t have to break the bank.

In most states you will be required to file an SR22 form with the state the violation occurred in. This state will require you carry minimum liability limits for the duration of the mandate. An SR22 form is nothing more than an addition to your auto insurance which shows financial responsibility to the state. If the policy is cancelled the state will be notified. It is a small fee to add this form to your policy but the big change is when your insurance company rates you for having a DUI on your license. There are ways to keep your rates lower.

Only carry liability coverage on the vehicle

If you only carry liability coverage you can save hundreds of dollars per year until your SR22 is no longer required. You may have a car which is financed and the bank requires full coverage, so sell that car and get one you don’t have to carry comprehensive or collision coverage on. I know you want that nice new car but you made a mistake and that may be the price you pay.

Get non-owner auto insurance if you don’t own a vehicle

Non-owner auto insurance is available if you don’t own a specific vehicle but still drive and need insurance. This is just a liability only policy which will cover you in any vehicle you drive. You can also add the SR22 filing to this policy so your state requirements are met.

NEW YORK – When a meeting with clients runs late, Andy Davidson doesn’t have to worry that his plane will leave without him.

Instead of impatiently waiting in mile-long security lines or silently waging war over a shared airplane armrest, Davidson can walk straight to his own six-seater, climb into the cockpit and take off.

Davidson, the owner of a New York-based financial consulting business, is a member of a small but growing group of businessmen who have taken their passion for flying and turned it into a more convenient — if less economical — form of transportation.

Most of these executives either buy or lease small planes, called single-engine pistons, with seating room equivalent to a family sedan and the ability to fly up to about 1,000 miles. With many airlines cutting back flights to smaller destinations, small business owners and midlevel executives are realizing that flying themselves might actually be feasible.

According to the Federal Administration Association, the number of hours single-engine piston planes are flown each year is expected to rise 17 percent by 2020, with growth of about 1 percent per year. Although some of that increase may be due to pilots who fly for recreation, FAA spokesman Hank Price said the government anticipates that business use of private aircraft will grow faster than leisure use.

Anecdotal evidence seems to confirm that more businessmen are seeing personal aviation as a transportation option. Flying clubs, where pilots can share ownership of a plane or receive additional training, are filling up with executives. One Atlanta-based club called Airshares Elite, founded in 1999, caters specifically to businessmen.

Airports have also started to recognize the importance of the businessman pilot. Clark County, Nev. recently spent $30 million remodeling Henderson Executive Airport, outside of Las Vegas, to appeal to executives.

Flying smaller planes — either by the executives themselves or the pilots they sometimes hire — has become so popular that it has begun to contribute to the nation’s air traffic and congestion.

But certainly, the benefits of private-plane travel are all too evident to anyone who’s ever been bumped from an overbooked flight or waited for takeoff at rush hour. Executive pilot Steven Hall, the managing director of his own executive compensation consulting firm, said he leaves his house only 30 to 40 minutes before he plans to take off rather than the two hours he budgets to go through security lines when taking a commercial flight. He said private planes, which leave from much smaller airports, are also not subject to the same delays in departures and arrivals as commercial flights using major airports.

“Most of us who travel on business can tell stories of sitting on the ground for four hours waiting for the plane to be cleared for takeoff for what was supposed to be a 90 minute flight,” Hall said.

Davidson agreed, saying that although the actual time in the air is about the same or possibly slightly longer in a private plane, flying yourself allows you to set your own schedule and makes for a much more relaxing trip.

“Any time I have to go on a commercial flight, it’s a depressing feeling,” Davidson said. “Between the check-in and the delays and the cattle-car feel of it, I think the whole experience has gone downhill.”

Davidson began flying after a friend took him on a small plane flight to East Hampton, New York.

“Until that moment it didn’t really occur to me that people could be pilots,” he said. “I thought only pilots could be pilots.”

Davidson got his license and after leaving Merrill Lynch & Co. in 1992 to start his own consulting group, he decided to buy a plane to visit clients. He upgraded to a larger six-seater Baron several years later and now uses it frequently for business.

“Just getting there becomes an enjoyable part of the travel,” he said.

Davidson does pay for that enjoyment. He estimated he spends about $50,000 a year on flying — including the cost of housing a plane in a hangar and maintaining it. That’s probably about $20,000 more than he would spend on commercial flights per year.

Phil Boyer, president of the Frederick, Md.-based Aircraft Owners and Pilots Association, said a new single-engine plane can cost about $400,000 to $1 million. Small used planes typically fall in the $50,000 to $60,000 range.

The process of getting a private pilot’s license also takes time. Boyer said the average is about six months, with 70 hours of flying time.

Hall earned his license in July. The East Islip, N.Y., executive bought a Cirrus SR22, a single-engine piston plane starting at about $370,000.

“I just took my time and plodded away and tried to learn how to land the thing,” said Hall, who estimated he’s flown about 50,000 miles so far and is thrilled with his investment.

For other businessmen, flying a plane can be even more of a necessity, noted Ed Bolen, president of the Washington D.C.-based National Business Aviation Association, which represents private aircraft users.

“There are cases where there are companies either located in communities that have lost commercial air service or seen frequencies go down,” he said. “Do they move the plant or facility or find a transportation alternative?”

There are also cases where a plane has helped save a business.

Richard Shine, who owns Manitoba Corp., a metal recycling business outside of Buffalo, N.Y., credits his plane with just that. Starting in the 1970s, companies in upstate New York that once provided scrap metal to Manitoba started moving their businesses elsewhere. To expand the company’s supply base, Shine began using a small plane, in which he owned a half-interest, to find new suppliers.

Since then, the company has bought a bigger plane — a Mitsubishi Mu-2 Solitaire — and now makes the aircraft a major part of its marketing materials.

“We think of it as the same as having another sales person on staff,” said Shine, a former Air Force pilot. “It costs about the same, but it doesn’t complain and it’s almost always willing to work.”
